MOXXOR Referred to FTC by BBB

Does anyone have any further info about MOXXOR being referred to the Federal Trade Commission by the Council of Better Business Bureaus?

According to the notice posted by the BBB, MOXXOR came to the attention of the Electronic Retailing Self-Regulation Program ( ESRP ) after an anonymous tip about their direct response advertising.

The entire basis for the inquiry is below. Please post any followup info. I'm totally surprised by this development, and would like to know if the company has posted any kind of response.

Moxxor Dietary Supplement

BASIS OF INQUIRY

Direct response advertising by Moxxor, LLC for the Moxxor dietary supplement

came to the attention of the Electronic Retailing Self-Regulation Program

(“ERSP”) pursuant to an anonymous complaint. After a review of online

advertising for the Moxxor dietary supplement, ERSP determined that the

following group of core claims (i.e., below also are representative statements in

each category of claims) were being communicated:

Comparative Performance Claims

 

“MOXXOR is the earth's preeminent source of Omega-3, which has

known anti-inflammatory properties and is up to 480 times more effective

than other Omega-3 oils on the market.”

 

“MOXXOR derives its powerful antioxidant properties from grape

seed extract, which have known antioxidant levels that are up to 3 times

more effective than acai and mangosteen, and up to 50 times more effective

than goji, as measured on the ORAC scale”

 

“As shown in the table below, the Moxxor omega-3 fatty acids found in

greenlip mussels are substantially more effective than found in other

omega-3 oils on the market like fish oil and flaxseed oil.” [accompanied by

chart detailing MOXXOR’s anti-inflammatory value]

 

“MOXXOR OMEGA-3 HAS AN ANTI-INFLAMMATORY VALUE

THAT IS: 158 times more effective than Fish Oil; 247 times more effective

than Salmon Oil; 316 times more effective than Evening Primrose Oil;

395 times more effective than Flax Oil”

 

The acai berry has received considerable attention as a naturally potent

antioxidant in recent years, yet as you will see below, it rates significantly

lower on the ORAC scale than the Moxxor antioxidant extracted from the

grape seed husk. [accompanied by chart detailing ORAC values]

 

“MOXXOR GRAPE SEED EXTRACT HAS AN ORAC VALUE

THAT IS: 3 times more effective than Acai Berry; 4 times more effective

than Mangosteen; 47 times more effective than Goji Berry; 114 times more

effective than Pomegranate”

General Performance Claim

 

“The MOXXOR Compensation Plan pays 2 ways: 1. Fast Money through

the ‘Binary System’ of up to $20,000 per week; 2. Forever Money through

the “Enroller system” to provide long-term residual income”

Superiority Claims

 

“…the most powerful all-naturalomega-3 and antioxidant on the planet

exclusively from the pure pristine environment of New Zealand”

 

“These New Zealand greenlip mussels have the highest concentration of

omega-3 essential oils on the planet.”

 

“In an effort to create an exceptional wellness product, Moxxor has

included the world’s most powerful antioxidant, extracted from the

sauvignon blanc grape seed husk.”

 

“Moxxor’s proprietary extraction process allows for a higher

concentration of docosahexaenoic acid (DHA) and eicosapentaenoic acid

(EPA) as compared to natural fish oils. Concentrations of DHA and EPA

will reach levels of 60% and 70% respectively compared to about 10% and

5% in natural fish oil. Studies have shown that the oils found in Moxxor

are of such a high concentration and natural balance that it would

take 247 capsules of salmon oil, for example, to equal just 1 capsule of

Moxxor”

 

“The visionaries and co-founders of MOXXOR, Noel and John Turner,

ERSP was concerned by the lack of disclosure information

accompanying the testimonials found in the “

 

product results

” section prominently

featured on the front page of the moxxor.com website as well as in the

testimonials found within both websites.

ERSP attempted to contact the marketer several times using the mailing address

provided by the challenger and listed in the public domain registration for the

website at issue in the inquiry. However, after receiving no substantial written

response after a fifteen (15) calendar day period, the marketer was afforded an

additional ten (10) day extension which again did not yield a substantive

response from the marketer. Upon failure to respond to ERSP’s follow up

correspondence, this self-regulatory forum ERSP had no alternative but to deem

the Moxxor LLC’s failure to submit a substantial written response as an

indication that it would not participate in the ERSP forum.

NON-RESPONSIVE DETERMINATION

An advertiser must be prepared to substantiate any claim that it makes before

public dissemination of the advertisement. ERSP initially attempted to contact

the marketer on August 12, 2009 requesting substantiation for the above stated

claims. However, the marketer failed to provide any substantiating information

in response to ERSP’s inquiry within 15 calendar days as mandated by the ERSP

Procedures.

In an attempt to insure the marketer be afforded every chance to respond to the

inquiry, ERSP followed up by sending copies of the opening letter of inquiry via

email and fax to the publicly available email address and fax numbers. However,

the marketer again failed to provide a substantial written response to ERSP.

On September 17, 2009, a second official attempt was made by ERSP to contact

the marketer by resending all of the original materials. Because the marketer has

similarly failed to provide a substantial written response within ten (10) days

from the mailing, ERSP referred this inquiry to the Federal Trade Commission

pursuant to section 2.6(B) of the

We confirm that MOXXOR is a PROPRIETARY BLEND 150mg soft gel-cap filled with 100% pure omega -3's and antioxidants, the exact amount is proprietary information that we cannot disclose. We use NO fillers, NO preservatives, NO carries and MOXXOR is FREE of ALL toxins.

Firstly, MOXXOR greenlip mussel oil contains a large range of different fatty acid groups (lipid groups) one of which is the omega-3 family. Within the omega-3 DHA family there are approximately 8 well represented omega-3 structures in both the triglyceride and phospholipids' forms. Two of these structures are better known than others, namely EPA and DHA.


EPA and are not a measure of how effective a product is. These are just two common figures given by unethical companies in order to convince consumers that their product is the one to buy and use. This is a very simplistic approach that has no scientific merit or basis.

The clical study on our MOXXOR website comparing common sources of omega-3 shows clearly that the effectiveness of a product has nothing to do with the very simplistic approach of how much EPA and DHA is actually in a product, but rather the synergistic results that both these compounds (EPA and
DHA) help to provide combined with a large number of other forms of omega-3s found in the greenlip mussel in the correct ratios and structures. What this means in very specific terms is even though the EPA and DHA aren't reading as high as one would naturally assume, the wellness benefit experienced
and the superior effectiveness is due to the unique combination and structures of omega-3s found in the greenlip mussel. This unique ratio and collection of omega-3 structures are not found in salmon, krill, cod, or anywhere else in nature. Greenlip mussel oil is significantly more effective than any
other natural form of omega-3 on the planet.


Results always speak louder than words or figures and if anyone takes the time to research the benefits of using greenlip mussel extract as a source of omega-3s they will be quickly convinced that this is the right approach in comparison to other natural sources of omega-3s.


The reason that MOXXOR provides a superior wellness experience to other products containing greenlip mussel extract is due to a number of steps in the treatment of the raw material and the unique proprietary processes used in MOXXOR's production. The result of these combined proprietary steps is
an extract that contains a lot more "polar" omega-3s, in particular in the phospholipids' form than any other greenlip mussel extract. These "polar" forms of omega-3s which include the well known DHA and EPA (which can be either "polar" and "non-polar") have been shown through clinical trials which are

body and the confusion it creates in the market-place.


MOXXOR on the other hand is completely natural with no synthetic adulteration of its natural ingredients and contains two forms of omega-3 oil (greenlip mussel oil and deep-sea marine oil) extracted from two clean natural sources that are sustainable, renewable, and well-managed resources.
The greenlip mussel oil extract has clinical trials that prove beyond doubt its efficacy in the most bioavailable form possible.


MOXXOR does not sell its product in a subversive manner using meaningless figures in order to trick consumers or take a simplistic approach treating its customers as stupid in providing only half the information. The BBB is not a government agency. They can say or do whatever they want, they have no teeth unless they threaten you with referral to the FTC - and even then, their referral has no more weight than if you or I decided to refer a company. I don't think anything here rises to the level that would get the FTC involved.

The same with the ERSP. It's a voluntary organization. Moxxor does not have to reply. It's the same as if all my neighbors got together and formed a Lawn Inspection Organization and started sending me letters saying my lawn doesn't comply with their guidelines. Who cares.

I'm seeing lots of stuff targeting Moxxor and the product and fillers and blah blah blah.  It's a solid product. People can either use it, or not.

Move along people, there's nothing to see here.

The BBB is just a company. A business.  They respond to complaints and ask companies to become BBB certified. People can call in any kind of complaint they want.

We had one once at a former company, where a customer claimed they couldn't reach anyone in customer service about some lame problem. The reality was, they were repeatedly dialing the wrong number. Even when we contacted the person, took care of the issue ( lost password ), and they reported back to the BBB that it really shouldn't have been a complaint to begin with, the BBB left it as a "Complaint: Resolved". As if they had performed some great public service by helping an idiot locate a correct phone number. They didn't even do that, they just forwarded us the complaint and we contacted the person directly.

Do you feel like a friendly wager. I will bet that if we get an independent lipid expert, preferably a professor, and we make a case about fillers. I would win and  will donate the money to a worthy charity

It is a not solid product, it has been adulterated with the likes of Olive Oil and I am as sure about that as the fact that the Sun will still be around tomorrow. Quite happy to have a formal debate but unfortunately everyone is ducking for cover. Perhaps Jeremy Harris would like to explain the 52% Oleic acid in the mussel oil component and the pathetic levels of Omega 3's, after all he has been studying GLMO for thirty years.... hmmmmmm.

No need to make a wager. You win this argument.

As soon as I started doing more research, and saw info about the "kiwi mussels" New Zealand scandal that has been stuck on one of the Co-CEOs and the lack of response by Moxxor to the claims being made  on many other sites about the fillers - I started to wonder, "why the silence?".

It doesn't make any sense, and with all the details being posted that support the fillers argument, and none that support the Moxxor argument, what else can I believe?

At this point, all I can believe is Olive Oil fillers and overblown product claims by Moxxor.

I love this website and I love reading through the Forums, but I have to say...for someone looking for a home based business opportunity, it can be scarey.  There are so many choices and some with really bad press attached, how is your average Joe supposed to feel confident about investing time and money.  I know...research, research, research...but lord sometimes that can make you want to hide your head under the covers. 

Any advice for treading the waters of this multi faceted industry?
